Privacy and information-sharing consent

Your consent for Disability and Mental Health Care Pty Ltd to collect, store, use and share your personal information in order to deliver your supports. The same for everyone; nothing to fill in.

As an NDIS participant with Disability and Mental Health Care Pty Ltd (we, us), we need your consent to collect, store and use your personal information so that we can deliver your supports. Please read this consent together with the Service Agreement, and agree to it on your documents page if you are happy with what it says. It is the same for everyone, and there is nothing to fill in.

1  Your sensitive information

We respect your privacy and your dignity. We only collect sensitive information — health, medical and disability-related information — when it is needed to provide your supports, and only if you give explicit consent or we are legally required to collect it.

2  Before you agree

We explain how we will use your information and who it may be disclosed to, and we make sure you understand, with an interpreter, an advocate or another person of your choosing if that helps. Ask us, in person or on 0488 114 368, before you agree. You can change this consent at any time (clause 9).

3  Keeping you informed

We tell you how your information is used and stored. You have the right to see it, to have it corrected, and to make a complaint. You can involve family, friends or your chosen community in any of this; tell us who on People with access.

4  What we collect

  1. your details and identifiers — name, contact details, NDIS number and plan dates, and who acts for you;
  2. service details — your support plan, bookings, shift notes, incidents and feedback;
  3. medical and disability-related information that your supports need, such as the clinical plans your plan says apply to you;
  4. financial information needed to invoice and claim — your funding arrangement and plan manager;
  5. records of our interactions with you — messages, calls and complaints; and
  6. audio, photo or video material only if you have given the separate Photo and media consent.

5  How we collect it

From you, through The Care Web and your conversations with us; from your support plan; from the people you have told us may act for you; from referrals you have agreed to; and from government agencies such as the NDIA where our registration requires it.

6  What we use it for

To tailor your support plan and deliver your supports; to answer your enquiries; to manage, review and improve our services; to meet our legal obligations as a registered NDIS provider, including audits; to tell you about changes that affect you; and to keep The Care Web working for you. We do not use it to train artificial-intelligence models, and we never sell it.

7  Who we may share it with

  1. the workers you book, who see the short brief from your support plan and, unless you switch it off, the clinical plans they must follow on a shift — and nothing else from your file;
  2. the people you have recorded on People with access, such as a representative or a plan manager, to the extent you have allowed;
  3. the NDIA and your plan manager, where claiming and invoicing require it;
  4. the NDIS Quality and Safeguards Commission, external auditors and other regulators, where our registration or the law requires it;
  5. other service providers and health professionals involved in your support — only when you tell us to, or in an emergency;
  6. law enforcement, courts or financial institutions where we are required or authorised by law; and
  7. anyone who needs to know in order to prevent an immediate risk of serious harm to you or someone else.

Apart from the last three, we share only what the purpose needs, and we record what was shared on your file.

8  What you control

The printed version of this consent asked you to tick boxes. On The Care Web each of those is a setting you can change at any time:

  1. Photos, video and audio — never collected or published unless you have agreed to the separate Photo and media consent on your documents page.
  2. Newsletters and marketing — off unless you turn them on under Emails & notifications. Messages about your bookings and your file are not marketing.
  3. Sharing with named people or providers — add them on People with access, or tell us and we record it.
  4. Anyone we must never share with — tell us, in writing or by phone, and we record it on your file and follow it regardless of who asks.
  5. Workers reading your clinical plans on The Care Web — the switch under My documents › What a worker can read.
  6. Surveys, research and quality activities — always optional; say no to any of them with no effect on your supports.

9  Changing or withdrawing your consent

Your consent continues until you tell us otherwise. You can change or withdraw it at any time by changing a setting above, or by telling us in writing or by phone. Some records must still be kept for the periods the NDIS rules and the law require, and we will tell you if a withdrawal means we can no longer provide a support safely.

10  Access, complaints and breaches

Our Privacy and Information Management Policy explains how to see the information we hold about you and how to complain about a privacy matter; complaints are handled under our Feedback and Complaints Policy, and you can also complain to the Office of the Australian Information Commissioner. Any breach or suspected breach of your privacy is taken seriously and managed under our Incident Management Policy, and you are told. 11  If someone agrees on your behalf

A parent, guardian, nominee or other representative recorded on your account may agree to this consent for you. By doing so they confirm that they are authorised to act for you, that they have read our Privacy and Information Management Policy and Incident Management Policy, and that they consent on your behalf to the uses set out here; and they agree that their own details may be used to administer this consent and to show evidence of it where required.

What agreeing means

Pressing I agree on your documents page records your name (or your representative’s, on your behalf), the date and the edition shown — v1, issued 23/08/2026 — and keeps a copy of this page as you saw it. It replaces the signature page of the printed form. If the text changes, you are asked to read and agree to the new edition; the earlier one stays on your file.
