Worker Screening Policy and Procedure

Purpose

Disability and Mental Health Care Pty Ltd (DMHC) engages only workers who are cleared to work with people with disability. This policy sets out who must be screened, what a clearance means, how DMHC verifies and monitors it, and what happens when a clearance changes. It gives effect to the National Disability Insurance Scheme (Practice Standards — Worker Screening) Rules 2018 and the NDIS Worker Screening Check arrangements in each state and territory.

Scope

This policy applies to every person DMHC engages in a risk assessed role: key personnel, anyone who delivers supports or services to a participant, and anyone whose normal duties bring them into more than incidental contact with participants. It applies to employees, contractors, volunteers, students on placement and any personnel supplied by another provider.

Policy statement

Definitions

Risk assessed role means a role of key personnel; a role for which the normal duties include the direct delivery of specified supports or services to a person with disability; or a role for which the normal duties are likely to require more than incidental contact with a person with disability.

Clearance means a current NDIS Worker Screening Check clearance decision recorded in the NDIS Worker Screening Database.

Acceptable check means a check recognised under the Rules and the transitional arrangements in the worker's state or territory, held while an NDIS Worker Screening Check application is being assessed.

Procedure

1. Identifying risk assessed roles. The Director assesses every role before it is filled and records the title, the duties, the category (key personnel; direct delivery; more than incidental contact), the date of the assessment and who made it. The list is reviewed whenever a role changes and at least annually.

2. Before a person starts. The person applies for an NDIS Worker Screening Check through their state or territory Worker Screening Unit, nominating Disability and Mental Health Care Pty Ltd, NDIS provider 4-LO5XNY0, as the employer. DMHC verifies the application in the NDIS Worker Screening Database within the time the Rules allow. DMHC also collects and verifies 100 points of identification, evidence of the right to work in Australia, the NDIS Worker Orientation Module certificate, a first aid and CPR certificate, and any qualification or training the role needs. A Working with Children Check is required for a worker who supports a participant under 18.

3. While an application is pending. A person whose NDIS Worker Screening Check application has been lodged and verified may start in a risk assessed role only where the Rules and the state or territory arrangements permit it, only with an acceptable check, and only under supervision arranged and recorded by the Director. The arrangement ends the moment a clearance or exclusion decision is made.

4. Recording and monitoring. The Care Web holds each worker's clearance number, expiry and verification on their file, and blocks bookings when a clearance has expired or has not been verified. DMHC remains linked to the worker in the NDIS Worker Screening Database so that any change in status is notified. The Director re-checks the NDIS Commission's banning orders register for every worker quarterly, and the result is recorded in The Care Web's compliance log.

5. When a status changes. If DMHC is notified, or becomes aware in any way, of an interim bar, suspension, revocation, exclusion, banning order or an allegation of misconduct involving a worker, the Director stands the worker down from every risk assessed role immediately, records the action, arranges cover for affected participants, and reports the matter where the Incident Management Policy or the Rules require. The worker returns to the role only when a current clearance is confirmed in the database.

6. Personnel supplied by another provider. Where another provider supplies personnel to deliver DMHC's supports, the written agreement requires that provider to use only cleared workers, to disclose clearance information before and during the engagement, to answer DMHC's information and investigation requests, and to withdraw immediately any person with an adverse status. DMHC verifies each such person in the database as it would its own worker.

7. Records. DMHC keeps, for each worker, the record of the role assessment, the clearance verification with the date and the person who verified it, the identity and right-to-work evidence, and every status change and the action taken. Records are kept for seven years after the engagement ends, in accordance with the Privacy and Information Management Policy.

8. Review. Screening records are sampled in the Internal Audit Schedule, and this policy is reviewed annually and whenever the Rules or the state or territory arrangements change.
