Tenancy and Support Separation Statement

Introduction

Purpose

The purpose of this Statement is to make unambiguous the separation between a participant's home (their tenancy or occupancy rights) and their supports (their choice of SIL provider). It gives effect to the supported independent living Practice Standards that commenced 1 July 2026 and supplements the Supported Independent Living (SIL) Policy and SIL Service Agreement.

Scope

This Statement applies to all Workers and to every participant receiving supported independent living or daily-living supports from Disability and Mental Health Care Pty Ltd in any dwelling.

Statement

A participant's home is never conditional on their choice of provider. Disability and Mental Health Care Pty Ltd will never make, imply, or allow others to believe that a participant's tenancy, occupancy or place in a dwelling depends on choosing, keeping, or not complaining about Disability and Mental Health Care Pty Ltd as their support provider.

Responsibilities and Roles

• Supriya Thapa is responsible for the development and review of this document and for ensuring it remains compliant with all applicable laws, regulations and standards.
• Key Management Personnel are responsible for its effective implementation, for assisting Workers to understand and comply with it, and for complying with it themselves.
• Workers are responsible for understanding this document and complying with all procedures applicable to them.

Definitions

Disability and Mental Health Care Pty Ltd means Disability and Mental Health Care Pty Ltd ABN 19 658 578 575, a registered NDIS provider (4-LO5XNY0).

Key Management Personnel means Supriya Thapa and other key management personnel involved in Disability and Mental Health Care Pty Ltd from time to time.

Worker means a permanent, fixed term or casual member of staff, a contractor or volunteer employed or otherwise engaged by Disability and Mental Health Care Pty Ltd, and includes the Director.

The Care Web means the Disability and Mental Health Care Pty Ltd service-delivery platform (thecareweb.com.au) that holds our booking, credential, incident, complaint and roster records.

Commitments

• Every SIL participant is informed, in writing and in a format they understand, at service commencement and at each agreement renewal, that they may change support providers without any risk to their housing, and that their occupancy continues regardless of who provides their supports.
• Housing arrangements and support arrangements are documented separately: the SIL Service Agreement covers supports only, and never contains terms that condition occupancy on the support relationship.
• Where Disability and Mental Health Care Pty Ltd has any role or interest in a dwelling (including arrangements with an SDA provider or head-tenancy arrangements), the interest is recorded in the Conflict of Interest Register, decisions about the tenancy and decisions about supports are made separately, and the participant is told plainly who is responsible for what.
• Participants are actively supported to access independent advice about their tenancy rights, including advocacy services and the local Tenants' Advice service, especially before signing or ending any agreement.

If tensions arise

• A complaint about supports never affects housing: complaints follow the Feedback and Complaints Policy, and no eviction, threat, or cooling of the housing relationship may result from a complaint or from a decision to change provider.
• Behaviours of concern that may put a tenancy at risk are addressed through behaviour support (see the Behaviour Support and Restrictive Practices Policy) and with the landlord or SDA provider as appropriate, with the participant leading, per the Supported Decision-Making Procedure.
• If a vacancy arises in a shared dwelling, it is filled in accordance with the SIL Policy, with each existing resident's needs, preferences and situation taken into account and recorded.

Evidence

Evidence of this Statement operating comprises: the signed acknowledgement in each SIL Service Agreement; house meeting minutes; Conflict of Interest Register entries for any dwelling interest; and complaint records demonstrating no housing consequences followed.

Policy review and updates

This document is to be amended and updated as required to remain compliant with applicable law, the NDIS Practice Standards, and the conditions of registration. It will be reviewed no later than the review date below, and earlier if legislation, the Practice Standards, or our operations change.
